Photography Terms of Service Agreement

This Photography Terms of Service Agreement (“Agreement”) is entered into by and between Champion Production Studios (“Photographer”) and the client (“Client”) for the provision of photography and videography services. By booking a session with Champion Production Studios, the Client agrees to the following terms and conditions:

1. Services:
Photographer agrees to provide photography and videography services as outlined in the booking agreement. This may include but is not limited to portrait sessions, event coverage, commercial photography, and boudoir photography.

2. Booking and Payment:
Client agrees to pay the agreed-upon fee for the photography and videography services, as outlined in the booking agreement. A non-refundable deposit, specified in the booking agreement, is required to secure the booking. The remaining balance is due on the day of the session or as otherwise specified.

3. Cancellation and Rescheduling:
Client understands that cancellations and rescheduling may impact Photographer’s schedule and availability. The deposit is non-refundable in the event of cancellation. Rescheduling requests should be made as soon as possible and are subject to Photographer’s availability.

4. Image and Video Usage Rights:
Photographer retains the copyright to all images and videos captured during the session. Client is granted a non-exclusive, non-transferable license to use the images and videos for personal or promotional purposes, including advertising and marketing. Commercial use of the images and videos requires prior written consent from Photographer.

5. Model Release:
Client grants Photographer permission to use images and videos captured during the session for promotional purposes, including but not limited to social media, website, and marketing materials. Client understands that their likeness may be used in conjunction with Photographer’s branding and marketing efforts.

6. Client Cooperation:
Client agrees to cooperate with Photographer during the session, including following directions, posing suggestions, and adhering to the agreed-upon schedule. Client acknowledges that Photographer may need to adjust the session based on factors such as weather conditions and lighting.

7. Liability:
Photographer will take reasonable precautions to ensure the safety of equipment and participants during the session. However, Photographer shall not be held liable for any accidents, injuries, or damages that may occur during the session.

8. Dispute Resolution:
In the event of any disputes arising from this Agreement, both parties agree to seek resolution through mediation or arbitration, conducted in accordance with the laws of [jurisdiction]. Any legal fees incurred as a result of disputes shall be the responsibility of the party found to be at fault.

9. Governing Law:
This Agreement shall be governed by and construed in accordance with the laws of [jurisdiction]. Any disputes arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of [jurisdiction].

10. Entire Agreement:
This Agreement constitutes the entire understanding between Photographer and Client regarding the photography and videography services and supersedes all prior agreements, whether written or oral. Any modifications to this Agreement must be made in writing and signed by both parties.

By booking a session with Champion Production Studios, the Client acknowledges that they have read, understood, and agreed to the terms and conditions outlined in this Agreement.
